The Entebbe High Court Circuit sitting at Kajjansi Chief Magistrates Court, has sentenced notorious land grabber Charles Kyagaba to an eight years imprisonment term, on two counts of obtaining money by false pretences.
On Monday, Justice Karoli Lwanga Ssemogerere, sentenced Kyagaba, after previously finding him guilty, last Friday and convicted him of obtaining money by false pretences for selling registered land he did not own.
According to prosecution led by Chief State Attorney, Mr Joseph Kyomuhendo and assisted by Ms. Janat Kitimbo, Chief State Attorney Entebbe, Kyagaba, together with others still at large, had for years terrorised residents of Wakiso District, especially in Entebbe, by fraudulently claiming ownership of their properties and selling them to unsuspecting victims.
Kyagaba was charged with two counts of obtaining money or goods by false pretences c/s 285 of the Penal Code Act, Cap 128 (the “Penal Code Act”).
On the first count, the Prosecution alleges that the accused on February 2, 2016 at Zziru village in Wakiso district, with intent to defraud obtained cash in the amount UGX 20,000,000/= from Kizito Ivan pretending to sell him land at Zziru measuring 11.5 decimals.
On the second count, the Prosecution alleges that the accused on March 20, 2016, with intent to defraud obtained cash in the amount UGX 10,000,000/= from the same victim, Kizito Ivan, pretending to sell him land at Zziru measuring 11.5 decimals.
During the hearing, prosecution asserted that Kyagaba had no lawful excuse for his conduct.
During sentencing, Justice Ssemogerere said prosecution had discharged its burden, to prove the ingredients of the offence of obtaining money by false pretences c/s 285 of the Penal Code Act, on both counts.
Justice Ssemogerere, sentenced Kyagaba to a total of eight years’ imprisonment on two counts of obtaining money by false pretences, with each count carrying a sentence of four years to be served concurrently.
