The Entebbe Magistrates court has issued an arrest warrant for embattled land broker Mohammad Kamoga after he failed to appear in court to answer charges of forging a lawyer’s practicing certificate in the fraudulent acquisition of a 200 acre land at Garuga- Bukaaya in Entebbe, Wakiso District.
Grade one Magistrate her worship Lilian Mazimwe issued the arrest warrant on Monday after the state attorney Paul Byamukama Aheebwa revealed to court that Kamoga who was declared Hospitalised at Nakasero Hospital by his lawyers and unable to attend court, was not in a life threatening situation at all and could ably attend court proceedings.
Kamoga faces charges including forgery, obtaining registration by false pretense, uttering false documents, unlawful eviction and malicious damage to property.
During the previous court hearing, Senior Grade one magistrate Edgar Tibayeita Tusiime directed the state to verify the ill-health claims by the broker, Kamoga through his lawyers, after he failed to appear in court regarding the ongoing case related to fraud of land.
“The state shall verify the information provided to court and thereafter court shall be at liberty to take action,” held Magistrate Edgar Tusiime Tibeyita before adjourning the case to September 29, 2025.
The court decision followed submissions in which the State Attorney Paul Byamukama Aheebwa vehemently objected to the long adjournment asked by Kamoga through his lawyers, who reported to court that he is unwell and admitted Nakasero Hospital.
On Monday, state attorney Paul Byamukama told court that upon verification with the hospital, he found that Kamoga was not admitted but rather only an outpatient at Nakasero hospital and able to attend court.
“The document that has been sent to the counsel today is not known at the hospital. It is not certified by the hospital. No one has come to claim that they know the document from the hospital, as opposed to the prosecution’s evidence to show that on that same day, that they are making a postmortem issue, I have records to show that it is not part of the medical records” Byamukama told court.
Kamoga’s lawyer’s led by Brian Tindyebwa attempted to convince court that Kamoga was indeed bed ridden even though not at Nakasero Hoapital as earlier stated but failed to provide certified documents from the hospital proving the same.
“Your Worship, the argument here is, the accused person is not admitted at the hospital, but he is sick, so that is the argument” he said.
Mr Tindyebwa brought the court to laughter after he stated that it was actually the prosecution delaying the hearing of the case since their client is always present in court, a statement that left the complainants and whole courtroom in laughter.
After listening to both submissions, her worship Mazimwe issued an arrest warrant noting that the medical documents provided by the defence were not certified by the hospital.
“I am inclined to rely on the documents that have been availed by the prosecution which are duly certified and clearly indicate that the accused person is not in any danger, I can only agree the accused person is a patient in Nakasero hospital however, there’s is no danger in regards to his sickness”
“For those reasons since in the last hearing criminal summons were issued for the accused person to appear today, I am going to issue a warrant of arrest in that regard that the accused person appear in court” she said.
She added, “If there is any issues regarding his medical condition if he is too ill to that extent you shall inform the court in that regard”
Her worship Mazimwe adjourned the case hearing to 6th October.
Kamoga’s legal troubles stem from allegations that he used forged transfer forms to unlawfully transfer land ownership from Peter Bibangamba into his names for over 200 acres of land.
Kamoga was expected to plead to the amended charge sheet, which is already on court record, where the Dpp has preferred additional charges of forgery against him.
Kamoga, whose name has consistently appeared in several land fraudulent dealings, is well-known for engaging legal gimmicks, filing frivolous complaints against judicial officers hearing the fraud cases against him and recycling applications which had already been determined.
