Dr Kizza Besigye and his aide Hajj Obeid Lutale are seeking the removal of the Nakawa Chief Magistrate Nantege Christine from their case accusing her of incompetence, abuse of judicial oath and Judicial malpractice.
In petition to the Judicial Service Commission, through their lawyers today, the duo raise accusations of misconduct and procedural violations after Nantege committed them, alongside Capt Denis Oola without legal representation in the treason case against them.
Besigye and Lutale noted that the Magistrates act violated their constitutional rights to counsel.
The two veteran politicians are now seeking for Ms Nantege to excuse herself from the case hearing pending the state’s application seeking to confiscate their phones.
The petition further cite the magistrates failure to maintain order in court, failure to consider the time spent on remand which allows for a mandatory bail and her attempt to hear an application after a
committal as abuse of judicial oath and Judicial malpractice.
The case hearing has been adjourned until 25th June for further hearing as the Judicial Service commission begins it’s inquiry into the petition.
