The City Hall Magistrates Court has charged and remanded 28-year-old Tik Toker Ibrahim Musana alias Pressure 24/7, over alleged hate speech against the Chief of Defence Forces, Gen Muhoozi Kaineugaba.
Musana has been charged with two charges of unlawful obtaining of personal data contrary to section 35 (1) and (2) of the Data Protection and Privacy Act, Cap 97 and Hate speech contrary to section 26(1) (a) and (2) of the Computer Misuse Act, Cap 96.
According to prosecution, on March, 5th at Asante Apartments Kyanja – Nakawa Division in the Kampala District, Musana unlawfully obtained or processed data including a photograph and name of General Muhoozi Kainerugaba, without prior consent of the said General Muhoozi Kainerugaba.
Prosecution further told court that on the same day, he used his Tik Tok account,@pressure247 to share information about or relating to General Muhoozi Kainerugaba, Chief of Defence Forces of Uganda People’s Defence Forces, that he is not fit to hold the office of Chief of Defence Forces, which information, according to prosecution, is likely to ridicule or degrade or demean General Muhoozi Kainerugaba.
The Court has remanded Musana who denied the charges to Luzira prison up to March, 26 when the case will come up again for mention.
Musana who is no stranger to the charges, was last year charged and remanded with similar charges in a case in which he had been accused of making offensive online posts about President Museveni, Kabaka Ronald Muwenda Mutebi, and other dignitaries.
However, in September, then Buganda Road Chief Magistrate Ronald Kayizzi acquitted Musana after the continued absence of prosecution witnesses left the court with no option but to dismiss the case.
