Court Denies Agasiirwe Bail in Kagezi Murder Case

The High Court Criminal Division Judge Isaac Muwata, has denied bail to Senior Superintendent of Police Nickson Agasirwe, who is charged with the alleged murder of former Assistant Director of Public Prosecutions Joan Kagezi.

Agasiirwe had petitioned court to grant him mandatory bail after spending more than 180 days on remand which is an infringement on his right to a fair trial.

However, Justice Isaac Muwata on Thursday ruled that  the DPP filed the Indictment and Summary of Evidence on 16th December 2025, fulfilling the constitutional 180-day threshold intended to prevent indefinite pre-trial detention.

“The purpose of the 180-day threshold is to prevent the State from holding citizens indefinitely without formalizing the charge for trial,” Justice Muwata observed.

“By filing the Indictment and Summary of Evidence, the State has met its obligation, and the mandatory grounds for bail have been overtaken by the committal proceedings.”

Court also was convinced that since by the time of committing the alleged offences, Nickson was at the rank of Senior Supritendant of Police, chances are high that he may interfere with the investigations since most of the officers investigating were his juniors by then.

The judge also ruled that Agasirwe can easily abscond once released given the nature of the charges against him.

Agasirwe was arrested in May last year after a one Daniel Kisekka told court that the deal to murder Kagezi was financed by one Nixon Agasirwe.

Kisekka was also in May 2025 sentenced to 35 years in prison after he pleaded guilty to having participated in the murder of Kagezi who was shot dead on the 30th March 2015 in Kiwatule a city suburb.

The four other suspects who are also still on remand include; Kibuuka John, Nasur Abdullah Mugonole, John Masajjage and Semujju Abdul Noor aliaz Minana.
