Entebbe Senior Magistrate Grade one, Edgar Tibayeita Tusiime has further remanded shoemaker and National Unity Platform (NUP) member Mr Juma Musuuza alias Madubarah until 16th June this month after the last state witness’s failure to attend court on Monday.
On Monday during the court hearing in which Madubarah is accused of alleged offensive communication meant to degrade President Yoweri Museveni, First Son Muhoozi Kainerugaba and Speaker Anita Among on Tik Tok last year, state attorney Mr Paul Byamukama told court that the last state witness was a no show in court.
Mr Byamukama asked court to for an adjournment and issuance of criminal summons after the witness, an officer at the Makerere University School of Humanities and Languages failed to appear in court to testify against Madubarah.
However defense lawyer Mr Jonathan Elotu objected to the request since court had directed the prosecution to present it’s last witness during the last court adjournment.
Mr Elotu said prosecution’s request to further adjourn the hearing means neither the document nor witness exist.
“Your Worship, it is our prayer that the prosecution closes it’s case to allow us to proceed with the defence if the accused person has any case to answer” he said.
His worship, Tibayeita adjourned the case until the 16th of June for prosecution hearing and sixth June for prosecution to disclose all evidence pertaining the case to the defense.
