The High Court in Kampala was on Thursday gripped with tension after Hajj Obeid Lutale’s daughter, Mariam Obeid launched a verbal attack at Justice Emmanuel Baguma over his refusal to refer the treason case of Dr Kizza Besigye, her father Hajj Lutale, and Capt Denis Oola to the Constitutional Court for interpretation.
Mariam Obeid, brought court proceedings to a halt after she demanded to know from Judge Baguma why he was wasting the accused’s time and remanding them back to prison after every court appearance.
“We are tired, we are tired, where is justice, let me talk to him where is the justice?” she questioned.
Mariam further asked Judge Baguma to stop treating the court like drama theaters which follow scripts.
“You have wasted our time for one year, we have been coming to this court for a full year and your busy reading a script every time, is this a theatre? This is not a theatre I will speak” she screamed as court guard’s mercilessly dragged her from the court room to the court holding cells.
The high court was expected to deliver a ruling on whether the treason case should be referred to the Constitutional Court for interpretation.
Following the resumption of the hearing, Judge Baguma denied the application by Dr Besigye and Lutale to have their case referred to the constitutional court.
The defense team applied to High Court to refer the matter to Constitutional Court to determine whether a trial judge against whom a complaint of bias and incompetence lies can be impartial in handling the case against the complainant.
Recently, Dr. Kizza Besigye and Obeid Lutale through their lawyers filed a complaint to the Judicial Service Commission against Judge Baguma for being biased and grossly incompetent, however the complaint has not yet been determined.
